Shemel Mercurius, 16, and Taariq Stephens, 25, met at a daycare and exchanged numbers. The two communicated for a few days before Mercurius stopped talking to him as she claimed she wasn’t interested in his advances. Stephens became enraged and traveled to an apartment complex where she was babysitting and shot her three times with a machine gun on May 31, 2016.

NYPD Officer Kyle Thomas Daly, a patrol officer, heard the shots and found the victim in a pool of her own blood. Daly testified in court that he entered the room and found the three-year-old child she was babysitting covered in blood also but uninjured, according to the Daily Mail.

He explained that he immediately called for EMS, but it took them 20 minutes to get there. Mercurius was struggling to stay awak and was going in and out of consciousness.

“I put on gloves, took her off the car and laid her down and began rendering aid … she regained consciousness, gave me her name and date of birth,” Daly said.

As the two waited for emergency services to reach the Flatbush apartment complex, officer Daly testified that Mercurius told him she had turned down Stephens and he became angry.

In one of her last breaths, Mercurius, who came to American four years ago from Guyana, told officer Daly that it was Stephens who shot her. He fled from the apartment complex after the shooting, per the New York Daily News.

The court also heard from Lona Junien, one of Mercurius’ friends who was heading up to her room to hang out when she heard yelling coming from the hall. Junien testified that she heard Mercurius yelling at Stephens before he shot and killed her.

“The person pushed her. The person said ‘Don’t ever lie to me.’ She was screaming, he took out the gun and shot her,” the 18-year-old said. Stephens faces 25 years to life if he is found guilty.
